Beyond a futile trial, the true nature of two men's intelligence
Elon Musk and Sam Altman are fighting each other in a federal courtroom in Oakland. The stated question is whether OpenAI betrayed its nonprofit mission.
April 28, 2026. The federal district court in Oakland, California. The trial began before Judge Yvonne Gonzalez Rogers.
Musk's attorney Steven Molo opened with this:
"Ladies and gentlemen, we are here today because the defendants in this case stole a charity."
OpenAI's lead counsel William Savitt replied:
"We are here because Mr. Musk didn't get his way at OpenAI. He quit, saying they would fail for sure. But my clients had the nerve to go on and succeed without him."
The two men in the gallery looked very different. Altman stood with his arms crossed, a worried expression on his face, talking with his legal team. Musk sat at the central table, staring at his notes, working his tongue against the inside of his cheek.
Musk took the stand. He began with the origins of OpenAI.
He had argued with Google co-founder Larry Page, who called him a "speciesist for being pro-human." Concerned that Google was not taking AI safety seriously, he conceived of OpenAI as a nonprofit "counterweight."
Then he came to the turning point. The fall of 2022, when he learned of Microsoft's $10 billion investment.
"At a $10 billion scale, there's no way Microsoft is just giving that as a donation. That amount of money doesn't make any sense as charity."
"I texted Sam Altman and said, 'What the hell is going on?' I think I said, 'This is a bait and switch.'"
He added:
"All due respect to Microsoft, do you really want Microsoft controlling digital superintelligence?"
Savitt confronted Musk with evidence.
Records showing that Musk himself had discussed setting up a for-profit subsidiary with Altman, Brockman, and Sutskever. Documents showing that Musk had intended to control the majority of the cap table and board seats.
Musk pushed back. "My control would have decreased over time as future investors demanded board seats."
Microsoft's attorney Russell Cohen produced his own evidence. A Musk post on X from September 2020:
"OpenAI is essentially captured by Microsoft."
Cohen argued: Musk knew about the Microsoft relationship in 2020. The lawsuit is past the statute of limitations.
Among the exhibits reported by CNN was an email from 2023.
Altman wrote to Musk: "You are my hero. But I am hurt by your attacks on OpenAI."
Musk replied: "It is certainly not my intention to be hurtful, for which I apologize. But the fate of civilization is at stake."
In public, Musk calls him "Scam Altman." In private, he is treated as a hero. In public, Altman dismisses Musk as someone who "didn't get his way." In private, he writes that he is hurt.
This trial is futile.
Any ordinary person can see that a trial like this is meaningless.
Human intelligence rests on four billion years of biological evolution. This is not a story about long stretches of time. It is about being selected, again and again, under the condition of survival.
Humans know pain. Humans know hunger. Humans carry the possibility of death. The body feels gravity. The skin feels the seasons. We learned, in our flesh, that we cannot survive without cooperating with others.
"Heavy," "hot," "dangerous"—these are not abstract symbols. They were acquired as bodily responses.
Intelligence depends on embodiment and on a history of survival. AI has neither. It cannot be bought with capital, with data, or with compute.
